Terms of Service

Welcome to Dotra. These Terms of Service form a binding agreement between you and VisionaryV LLC, a Texas limited liability company, and govern your access to and use of dotracompliance.com and the Dotra compliance platform. By accessing or using the Services, by clicking I agree, or by creating an account, you agree to be bound by these Terms. If you do not agree, do not access or use the Services.

Relationship to Other Agreements

These Terms apply to all use of the Site. If you have signed a Master Subscription Agreement with Dotra, that MSA controls with respect to the paid platform in the event of a conflict. Your use of the Services is also governed by our Privacy Policy at dotracompliance.com/privacy.

Eligibility and Accounts

You must be at least 18 years of age to use the Services. The Services are intended for commercial entities and individuals acting in a business capacity including motor carriers, owner-operators, and other transportation industry participants. When you create an account you agree to provide accurate information, maintain account security, and promptly notify us of any security breach at support@visionaryv.net.

Acceptance of Terms

You accept these Terms by clicking a button indicating acceptance, creating an account, or using the Services. We may update these Terms from time to time. Your continued use of the Services after any update constitutes acceptance of the updated Terms.

License and Acceptable Use

Beta Services

From time to time we may make features available on a beta or pre-release basis. Beta Services are provided as is without warranty. We may modify, suspend, or discontinue Beta Services at any time. You assume all risk associated with your use of Beta Services including any reliance on Beta Services for regulatory compliance.

User Content

You are solely responsible for content you submit through the Services. By submitting content you grant us a license to use it in connection with operating the Services. You will not submit content that is unlawful, defamatory, harassing, or that infringes any third party rights.

Intellectual Property

The Services including all software, content, designs, logos, and trademarks are owned by Dotra or its licensors. Dotra and the Dotra logo are trademarks of VisionaryV LLC. All rights not expressly granted are reserved. Copyright complaints may be directed to copyright@dotracompliance.com.

Third-Party Services

The Services may contain links to third-party websites. We do not endorse or assume responsibility for any third-party content or services.

Feedback

If you provide feedback or suggestions regarding the Services you grant us a perpetual, irrevocable, royalty-free license to use such feedback for any purpose without compensation or attribution to you.

Indemnification

You agree to defend, indemnify, and hold harmless Dotra and VisionaryV LLC from and against any claims, liabilities, damages, and expenses arising out of your use of the Services, your violation of these Terms, your violation of any third party rights, or your violation of any applicable law or regulation including the Federal Motor Carrier Safety Regulations.

Termination

You may stop using the Services at any time. We may suspend or terminate your access at any time if we believe you have violated these Terms. Upon termination your right to access the Services immediately ceases.

Limitation of Liability

Dispute Resolution

Before initiating formal legal proceedings contact us at legal@dotracompliance.com and attempt to resolve any dispute informally for at least 30 days. These Terms are governed by the laws of the State of Texas. Any legal action will be brought exclusively in the state or federal courts located in Texas. EACH PARTY WAIVES ITS RIGHT TO A TRIAL BY JURY. ALL CLAIMS MUST BE BROUGHT IN AN INDIVIDUAL CAPACITY AND NOT AS A CLASS ACTION.

General Provisions

These Terms together with the Privacy Policy constitute the entire agreement between you and us. You may not assign these Terms without our prior written consent. If any provision is held invalid the remaining provisions remain in full force.
